MLROs.com are pleased to bring you the third of our regular industry renowned conferences for 2019.  Our conferences are always a great value, full-day event, packed with major topical issues and expert speakers. We are excited to be able to reveal that the day will be keynoted by Jonathan Fisher QC! The rest of the agenda will follow shortly.

The delegate fee includes refreshments, lunch and a post-event networking drinks reception, hosted by our friends at Winckworth Sherwood. The conference will be held at their London offices which are located at Minerva House, 5 Montague Cl, London SE1 9BB on Wednesday, 25th September 2019.

Compliance in a Post-Fintech World

In this session Sameer covers 3 key areas of financial crime compliance that have materially changed by the advent of fintech financial service firms and what lessons and pointers MLROs and fincrime professionals should take from them as we move into a post fintech world:

  1. As customers become increasingly au fait with non face to face and app based relationships, how do fincrime professionals keep up with regulation that is often trailing behind the technological curve? AI presents new challenges – what becomes of a compliance audit trail when an AML risk decision is made by a ‘black box’ machine learning approach?
  2. Fintech firms are on the cutting edge of the monotonous processes that drive compliance operations, onboardin, transaction monitoring and so – it’s not just speeding up processes but improving effectiveness and reducing false positives. Big data is changing the game and is well on the way to reducing fraud and potential AML issues much more rapidly than before.
  3. Real time monitoring will be crucial to preventing potential breaches that led to the downfall of Danske the PPI apocalypse and whatever else is around the corner, how can we leverage the move to real time to pre-empt and prevent AML risk issues?

Jury service is an important public duty. You will be asked to consider the outcome of a trial in the high court. You will be asked to consider the case of Gringotts Bank Plc v Borgin & Burkes Limited.

We are asking you to assist Ms Justice Geyton decide on the outcome. Throughout the course of the hearing, you will be asked to consider the following points, among others:-

– whether closing a customer’s bank accounts could infringe competition law principles
– what consideration should be given to the risk of sending money abroad.
– the relationship between data protection principles with the current money laundering law

You are expected you to perform your duty as a juror with all care and diligence in order to uphold the rule of law.

The recent growth of Artificial Intelligence (AI)and Machine Learning (ML) is starting to promise a revolution in the way that due diligence and alert monitoring is conducted. There is the potential, over the next few years, for these systems to take over from human beings in these roles. Given the need for banks and other FIs to rein in massive spending on compliance, will these systems ever entirely replace people and are we in danger of watering down our compliance in the rush to automate?

Extension to the SMCR

Following the implementation of the Senior Managers and Certification Regime (“SMCR”) to banks and dual-regulated firms in 2016, the FCA has now published its final rules on the forthcoming extension of the SMCR to solo-regulated firms which will apply from 9 December 2019.

We will focus on the common requirements of SMCR which apply to institutions across the financial sector and its linkages to governance and culture. We will also share our industry insight (including case studies) on some practical steps which senior management, certified staff and relevant support functions can take to ensure they are compliant with regulations whilst strengthening accountability within their organisations.
